  • Our Service: These terms cover your use of the North American Crane Bureau (NACB) website, training portals, and related services.
  • Your Obligations: You agree to provide accurate information, keep your account credentials secure, and maintain a safe, respectful environment whether you are learning online or participating in hands-on training.
  • Payments: Course fees, training programs, and certifications must be paid according to the agreed-upon billing cycle or invoice terms. We outline our cancellation and refund expectations clearly.

1. Welcome & Agreement

Welcome to the North American Crane Bureau (NACB), a proud member of the Steel River family of companies. For more than 35 years, we have been a trusted partner in workforce development, providing industry-leading crane, rigging, heavy equipment, and industrial safety training across North America.

These Terms of Service act as a legally binding contract between you and NACB. By accessing our website, registering for a training program, or using our digital simulation technologies, you agree to follow these rules. We wrote these terms to clearly explain what you can expect from us and what we expect from you in return. If you do not agree with any part of these terms, please do not use our services.

If you have any questions about this document, please reach out to us at marketing@cranetechusa.com.

2. About Our Service

We are dedicated to advancing workforce development and improving workplace safety. NACB provides over 40 specialized training and certification programs covering cranes, rigging, aerial work platforms, forklifts, and train-the-trainer disciplines. We deliver these through classroom instruction, hands-on learning, on-site training, and advanced crane simulation technologies.

Eligibility

Because our training involves heavy machinery and industrial safety protocols, you must be at least 18 years old to register for our programs or use our digital services. By using our services, you confirm that you meet this age requirement and have the legal authority to enter into this agreement, either for yourself or on behalf of your employer.

Service Availability

We work hard to ensure our online training portals and digital resources are available when you need them. However, we occasionally need to perform maintenance or update our curriculum. We do not guarantee that our digital services will be uninterrupted or error-free, but we will always do our best to minimize any downtime.

3. Your Account

To access specific training modules, certification records, or simulation software, you may need to create an account with us.

Registration and Accuracy

When you create an account, you must provide accurate and complete information. Because we issue professional certifications and safety credentials based on your profile, using fake names or incorrect employer information is strictly prohibited.

Account Security

You are responsible for keeping your password and login details secure. Because certifications are tied to individual users, you may not share your account credentials with colleagues, friends, or family members. If you suspect someone else has gained access to your account, you must notify us immediately.

Account Termination by You

You have the right to close your digital account at any time by contacting our support team. Please note that closing your account does not erase your historical certification records, which we are required to maintain for compliance and verification purposes.

4. Acceptable Use

We want our platforms and training environments to be safe, educational, and professional. To maintain this standard, we have established clear boundaries for how you can use our services.

What You Can Do

You are encouraged to use our materials to learn, prepare for certifications, and improve safety at your workplace. You may download materials specifically marked for offline use, provided you keep all copyright and proprietary notices intact.

What Is Prohibited

To protect our intellectual property and the integrity of our safety programs, you agree not to:

  • Copy, distribute, or reverse-engineer our advanced crane simulation technologies or online training portals.
  • Share test answers, certification exams, or proprietary training manuals with unauthorized individuals.
  • Use our website or services to transmit malware, spam, or harmful code.
  • Engage in unsafe, disruptive, or unprofessional behavior during any in-person, on-site, or virtual training sessions.

Consequences of Violations

If you violate these acceptable use rules, we reserve the right to suspend or terminate your account immediately. In cases involving cheating or severe safety violations, we may also revoke your certifications and notify your employer.

5. Content & Intellectual Property

Our training programs are the result of decades of industry experience and expertise. We believe in being clear about who owns what.

Our Ownership

NACB retains all ownership and intellectual property rights to our website, training curriculum, safety manuals, videos, simulation software, and certification exams. Using our services gives you a limited, personal, non-exclusive license to access these materials for your own educational and professional development. It does not give you ownership of our content.

User-Generated Content

If you submit feedback, testimonials, or participate in forum discussions on our platforms, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content to improve and promote our services.

6. Payments & Billing

We believe in transparent pricing for our specialized training and certification programs.

Pricing and Billing

Prices for our classroom instruction, on-site training, and digital programs are outlined during the registration or contracting process. Depending on the service, you or your employer may pay via credit card, electronic transfer, or corporate invoice. You agree to pay all charges associated with the services you select on time.

Refunds and Cancellations

We understand that schedules in the manufacturing and construction industries can change. If you need to cancel or reschedule a training session, please notify us as soon as possible. Specific refund eligibility and cancellation fees depend on the type of training booked and how much notice you provide. These specific terms will be provided to you at the time of purchase.

7. Privacy

Your privacy is important to us. We collect standard business operational data to manage your training, issue certifications, and improve our services.

We comply with applicable US state privacy laws, including the California Consumer Privacy Act (CCPA) and its amendments (CPRA). We only share your data with essential service providers who help us run our business, such as hosting platforms and payment processors. For a complete explanation of how we collect, use, and protect your personal information, please read our full Privacy Policy.

8. Disclaimers & Limitations

We take immense pride in the quality of our safety training, but we must be realistic about the inherent risks of industrial environments.

Service "As Is"

Our digital services and training materials are provided on an "as is" and "as available" basis. While we strive for accuracy and excellence, we do not make any warranties, express or implied, regarding the absolute completeness or error-free nature of our content.

Safety Disclaimer

NACB provides educational training designed to improve workplace safety and operator knowledge. However, completing our training programs does not guarantee that accidents, injuries, or equipment damage will not occur. The ultimate responsibility for the safe operation of cranes, rigging, and heavy equipment lies with the individual operator and their employer. We are not liable for any workplace incidents, injuries, or damages that occur after you complete our training.

Limitation of Liability

To the maximum extent permitted by law, NACB and the Steel River family of companies shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you for any claims arising from these terms will not exceed the amount you paid us for the specific training or service in question over the past twelve months.

9. Dispute Resolution

If a problem arises, we want to solve it fairly and efficiently.

Informal Resolution

Before taking formal legal action, you agree to contact us at marketing@cranetechusa.com to describe the issue. We will work with you in good faith to resolve the dispute informally within 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, both parties agree to resolve any claims through binding arbitration rather than in court. Arbitration is a less formal process that uses a neutral arbitrator instead of a judge or jury.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10. Changes & Termination

Businesses evolve, and our terms need to keep up with new technologies and legal requirements.

Modifying These Terms

We may update these Terms of Service from time to time. When we make significant changes, we will update the "Effective Date" at the top of this page and may notify you via email or through a notice on our website. By continuing to use our services after changes become effective, you agree to the updated terms.

Our Right to Terminate

We reserve the right to suspend or terminate your access to our digital platforms or training programs at any time, without notice, if you breach these terms, engage in unsafe conduct, or if we are required to do so by law.

11. General Legal

These final provisions ensure our agreement functions properly within the legal system.

Governing Law

These terms are governed by the laws of the United States and the state where NACB is headquartered, without regard to conflict of law principles.

Severability and Entire Agreement

If any part of these terms is found to be unenforceable by a court, the rest of the terms will remain in full effect. These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and NACB regarding your use of our services.

Assignment

You may not transfer or assign your rights under these terms to anyone else, as your certifications and training records are specific to you. We may assign our rights and obligations under these terms to another company within the Steel River family or in the event of a merger or acquisition.
